Local media outlets are reporting a Towns County Grand Jury on Tuesday, issued a second indictment against suspended Sheriff Ken Henderson.
The superseding indictment replaced the original indictment that a separate grand jury handed up in October of last year.
The new indictment was sought by Enotah Judicial Circuit District Attorney Pro Tempore Frank Wood in an effort to avoid potential legal challenges tied to the original indictment.
Concerns were raised that the earlier grand jury included a juror whose physical residence is in Clay County, North Carolina, which is outside the legal jurisdiction for Towns County.
Henderson is facing seven criminal charges in total with five felonies and two misdemeanors stemming from a Dec. 13, 2024 roadside altercation involving him and Hiawassee Police Officer José Carvajal.
Henderson has entered a plea of not guilty to all charges.
The case remains pending, with no trial date currently scheduled.
