NFA NEWS UPDATE PART 1 | OHUB News
Over the past few weeks, there has been a lot of news involving several NFA cases. To jog your memory, the significant cases include Jensen v. ATF, Brown v. ATF, and Sonzinsky v. United States. So, over the course of the following several news articles, I’ll do my best to catch you all up on the relevant news and happenings.
This recent news comes from Gun Owners of America’s ongoing “Big Beautiful Lawsuit” and the DOJ’s recent opinion.
Is the DOJ 2A Friendly?
In a recent move, the Department of Justice (DOJ) has intensified its support for the National Firearms Act (NFA), sparking outrage. What started as a long-standing regulatory fallback — the NFA’s registration requirements — is now being justified with constitutional arguments related to the “Necessary and Proper” and Commerce Clauses. This is a legal shift that critics argue undermines the spirit of the Second Amendment—and picks up anti-gun rhetoric—arguing that the reduction of the tax fee to $0 is not enough to warrant removal from the NFA.
Under this renewed DOJ stance, the registration mandate isn’t just about taxes or tracking certain firearms; it could lay the groundwork for a nationwide ban and registry on any firearm considered “particularly dangerous” or “easily concealable.” In other words, this might pave the way for broad restrictions far beyond what most gun owners expected under current law.
For gun owners and 2A rights advocates, this is a warning of the upcoming fight. The move indicates not only a legal shift but also a potential existential threat to gun carry and ownership rights across America. So much for being on our side…
GOA Response
The GOA expressed their anger on social media, sharing their fury and sense of betrayal. They posted:
“We are disgusted by this brief and are demanding AG Bodi and the DOJ publicly explain and retract all portions of the brief that advance a limitless theory of federal power.”
The GOA has posted a call to action and a script for people to use to denounce the DOJ’s actions.
Zooming Out
Because if history has taught hunters, shooters, and firearms owners anything, once registration creeps in, the next step is restriction. And that’s a path none of us should let the DOJ walk us down.
