CLAYTON -– A school janitor at Rabun County Middle School was arrested and booked into the Rabun County Jail after being accused of Grooming a Minor for Sexual Offense following an incident that occurred on October 31, 2025.
Details of the arrest
The individual arrested is identified as Daviel Guevara, a 64-year-old Hispanic male from Tiger, Georgia, who was employed as a janitor at the middle school. The investigation began after the child’s mother alerted the school principal. According to the police report, the mother stated that Mr. Guevara asked her daughter, a student under the age of 16, to “perform an act that she [the mother] deemed inappropriate.”
Surveillance evidence and allegations
Further investigation, which included reviewing school surveillance video, revealed additional interactions between Guevara and the female student.
The video reportedly captured Guevara telling the female student “I love you, I miss you” as she was heading to the restroom. He can also be heard asking the child if she is “coming on Monday,” and inquiring about her social media accounts.
In addition to these statements, the report alleges that Guevara asked the child to take a picture of herself with his phone while in the bathroom. As the child returned to class, he offered her a piece of candy and allegedly caressed the child’s hand as she retrieved the treat from him.
Official Statement
The police report concludes its assessment of the evidence by stating, “Based on the totality of the circumstances, Mr. Guevara appeared to convey a level of affection or intimacy that was inappropriate for a student-staff interaction.”
Guevara was subsequently arrested and is being held at the Rabun County Jail. Guevara was also issued a criminal trespass warning from the school.
