After it was reported that Pendergrass Police Chief Billy McDaniel was put on administrative leave after evidence allegedly disappeared, the Georgia Bureau of Investigation (GBI) has confirmed no charges will be coming.

McDaniel submitted his resignation on Oct. 25.

“The investigation has been completed, and Billy McDaniel turned in his resignation to me on Saturday,” Mayor Bill Ellis said at an Oct. 28 city council meeting.

The GBI told AccessWDUN that their investigation was submitted to District Attorney for the Piedmont Judicial Circuit Brad Smith.

After a review, the DA’s office determined that there was no criminal intent, just violations of policies and procedures.

What the Pendergrass Police Department does for its next police chief is not known at this time.
